The U.S. Supreme Court just issued a decision affirming the prior courts' decision in the case of Chamber of Commerce v. Whiting. This law suit was part of the Arizona 1070 law that passed a couple of years ago forcing all Arizona employers to use E-Verify or they will lose their business license. A similar measure was passed within Georgia's new immigration law HB87, requiring all Georgia employers to use E-Verify or they will lose their business license, Atlanta immigration lawyer Karen Weinstock reports.

"The Court found that the Arizona law was valid and not preempted by federal law because the law did no more than impose licensing conditions on businesses operating within the State. Regarding E-Verify, Congress had made the program voluntary at the national level, but it had expressed no intent to prevent States from mandating participation so that provision was also invalidated" said Karen Weinstock, Atlanta immigration attorney and the managing attorney of the Atlanta Immigration Law Firm Siskind Susser.

"What does it mean for Georgia businesses? For us in Georgia it means that the E-Verify requirement in HB87 is here to stay and it will be futile to argue or sue about it in Federal Court. Employers with more than 10 employees will have to comply, although there may be some loopholes" said the Georgia immigration lawyer.

"It is important to understand that it does not mean the other provisions of HB87 will stay (especially about show me your papers, racial profiling and other unconstitutional provisions in HB87) but the E-Verify requirement is solid and here to stay and businesses have to get ready for it", added the Georgia immigration attorney Karen Weinstock.

"We already received a number of concerned communications from employers and we are working with our clients to educate them about the E-Verify program and help them comply and work with the system. For those who want to use the loopholes we are helping too", concluded the Atlanta immigration attorney Karen Weinstock.
